These Terms of Service ("Terms") govern your use of Fintastic (the "Service"), operated by Fintastic ("we", "us", "our"), based in Leicester, England. By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Fintastic is a web-based aquarium monitoring and management tool. It lets you log water parameters, track livestock, and record events for one or more tanks. We may add, change or remove features at any time; where a change materially reduces functionality we will give you reasonable notice.
Fintastic is offered on a subscription basis. The current plans and prices are shown on our pricing page. All prices are in pounds sterling (GBP) and include VAT where applicable.
The number of tanks you may create depends on your subscription plan. If you exceed your plan's tank limit you will be prompted to upgrade. We will not delete tanks that exceed your limit if your plan is downgraded; you will simply be unable to add new tanks until you are within the limit.
You own your data. We store it on your behalf to provide the Service. You can export your tank data at any time using the CSV export feature in the app.
When your trial ends, your data is kept for 14 days to give you the opportunity to subscribe. After 14 days without an active subscription, your account and all associated data are permanently deleted. We will send you a reminder email before deletion.
When you delete your account, all personal data and tank data is permanently removed from our systems. This action cannot be undone.

We aim to keep Fintastic available at all times but cannot guarantee uninterrupted access. The Service is provided on a reasonable-endeavours basis. We are not liable for downtime caused by factors outside our control, including hosting provider issues, force majeure events, or scheduled maintenance.
We will endeavour to give reasonable advance notice of planned maintenance that is likely to cause significant disruption.
To the fullest extent permitted by law:
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded by English law.
Fintastic, its design, code, and content (excluding your data) are our intellectual property. You may not copy, modify, distribute or create derivative works from any part of the Service without our written permission.
We may update these Terms from time to time. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the Service. Where possible we will give you prior notice and the opportunity to remedy the breach. Upon termination your data will be handled in accordance with our Privacy Policy.
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
